Banks grant short sales for two reasons: the seller has a hardship, and the seller owes more on the mortgage than the home is worth.

The seller will need to prepare a financial package for submission to the short sale bank. Each bank has its own guidelines, but the basic procedure is similar from bank to bank.

A few examples of a hardship are:
Unemployment / reduced income
Divorce
Medical emergency
Job transfer out of town
Bankruptcy
Death

The seller’s short sale package will most likely consist of:
Letter of authorization, which lets your agent speak to the bank.
HUD-1 or preliminary net sheet
Completed financial statement
Seller’s hardship letter
2 years of tax returns
2 years of W-2s
Recent payroll stubs
Last 2 months of bank statements
Comparative market analysis or list of recent comparable sales

Writing the Short Sale Offer and Submitting to the Bank

Before a buyer writes a short sale offer, a buyer should ask his or her agent for a list of comparable sales.

Banks are not in the business of giving away a home at rock-bottom pricing. The bank will want to receive somewhat close to market value.

The short sale price may have little bearing on market value and may, in fact, be priced below the comparable sales to encourage multiple offers.

After the seller accepts the offer, the listing agent will send the following items to the bank:
Listing agreement
Executed purchase offer
Buyer’s pre-approval or proof of funds letter and copy of earnest money check
Seller’s short sale package.

The Short Sale Process at the Bank

Buyers may wait a very long time to get a response from the bank. It is imperative for the listing agent to regularly call the bank and keep careful notes of the short sale process.

Buyers may get so tired of waiting for short sale approval that they may feel the need to threaten to cancel if they don’t get an answer within a specified time period.

That type of attitude is self-defeating and will not speed up the short sale process. If buyers are the type with little patience, perhaps a short sale is not for them.

Following is a typical short sale process at the bank:
Bank acknowledges receipt of the file.
A negotiator is assigned.
The bank orders a valuation of the property.
The file is sent for review or to the investor.
The bank may then request that all parties sign an Arms-Length Affidavit.
The bank issues a short sale approval letter.

Some short sales get approval in 3 weeks. Others can take as long as 12 months. A typical Short Sale transaction takes 4-6 months to complete.

I remember writing earlier this year that I had finally gotten to the point of only having very few Short Sales ...it wasn't but 30 days or so later...when out of nowhere...Came A Batch...not just 5 or 6...but over 10...WHAT? What had happened? Where are these coming from? And you know what? They are now Super Powered...what is that you say?

I mean ones that are so far advanced that they still blow me away...Now It seems Banks will wait for BK's to Discharge only to ask the Non-obligated Borrower if they would like to skip going to Foreclosure and participate in a Short Sale instead(WHAT???-YEP)...word to the wise...No matter what I have found that sending everything to the BK Depts. also helps in the Short Sale...

I am also getting the properties with Home Assistance tacked on or Emergency Funds that helped them stay in the house prior to...tracking folks down on these is a bit timely...for us it was almost all done through NC Housing or HUD for the emergency funds...

Those are just a few...Just when you thought we could sit back...Life smacks ya with opportunity(Regular agents still don't want to do Short Sales...so they toss these files over to The Short Sale Agents "known for getting our hands dirty"-so to say)...

Better watch what you say out loud...Just when you say "I wouldn't mind a few short sales again..."...a lot of folks will hear you...and then it will be a bunch; all at once...Just like the old days...

First-Time Homebuyers Discounts through FHA

People in the market for their first home can take advantage of a new offer from FHA. This new initiative aims to provide more information to buyers though classroom education and will reward them with a reduction in the premiums paid towards mortgage insurance.

HAWK to the Rescue

The name of the new initiative is called Homeowners Armed with Knowledge (HAWK). The borrowers are asked to complete a series of classes prior to buying the home as well as a few courses scheduled after the home has been purchased. At the time of this writing the classes are broken down in the following ways

* 1st class to be completed before the buyer completes a purchase contract

* 2nd class will be completed after a contract is signed and before the loan is finalized

* 3rd class will be completed within 12 months after the loan is finalized

Goals of the Program

Simply put, the HAWK initiative is hoping that people buying their first home will have a better understanding of the overall process thanks to the counseling and will be in a better position to make wise financial decisions in the future not only in regards to their housing but also to their other needs.

Monetary Benefit

Once the customer has completed the necessary classes their upfront mortgage insurance premium will be reduced along with the monthly premium that is paid as part of the mortgage payments. In addition, if the customer has no delinquent mortgage payments within the first 2 years of the loan the monthly premium will be reduced again.

Some Limits and Expiration Dates

Since this is a new program with no history to review the FHA is rolling this out with limits. The program is currently scheduled to only last for 4 years. In addition, not all FHA loans are going to be accepted under this program. At this time there is no news about how many loans will be allowed to use HAWK but FHA has stated that there will be a maximum number each year.

Class Time Requirement

For the class completed before the contract signing the prospective buyers will need to finish at least 6 hours of counseling and education.

The class that is conducted after the contract signing is a one hour class as well as the class that comes after the loan is closed.

Each class will issue a certificate to the students indicating that the course has been successfully completed. These certificates will be necessary in order to get the reduction in mortgage insurance premium.

In general, this is a great program that FHA is offering. It provides critical information to potential home buyers in order to better prepare them for a prosperous future and it rewards them by reducing the amount paid on their mortgage.

Wisconsin’s red-hot real estate market cooled in October, with sales of existing homes nearly identical to October of last year, according to the most recent housing report issued by the Wisconsin Realtors® Association. October sales were just 0.1 percent lower than last October, representing the first time since July of 2011 that monthly sales did not increase over the previous year. The median sales price however continued to rise, increasing 5.6 percent to $142,500 in October relative to October 2012. On a year-to-date basis, median prices increased 7.5 percent compared to the first 10 months of 2012.

While somewhat surprising, these numbers are not totally unexpected,” said Steve Lane, chairman of the WRA board of directors. “We are comparing sales between two very strong years and two very healthy markets,” he said.

Sales softened in all regions of the state. The strongest regional growth was in the South central region, where sales were up 3.9 percent.

The Wisconsin housing statistics are in for November of 2013. Here is an excerpt from what the Wisconsin Realtors® Association (WRA) had to say:

Wisconsin home sales fell 6 percent in November 2013 when compared to November 2012, although total sales for the year remain ahead of 2012. Comparing the first 11 months, home sales were up 11.1 percent in 2013 over 2012. Prices were also higher in November, rising 4.7 percent above the same month last year, to a statewide median of $136,000.

Over the last two months, the housing market has definitely cooled from the red-hot pace that characterized the first three quarters of 2013.” said Steve Lane, chairman of the WRA board of directors. “This was bound to happen since the base of comparison is 2012, and that was a very strong year for home sales.” he said.

Lane pointed to markedly higher mortgage rates, steady upward movement in prices over the last year and a half, and heightened uncertainty of federal fiscal and health care policies as potential factors for the cool down..

Hello Fellow Short Sale Agents...

As I write this, I started thinking about all the past Clients' I have helped with Short Sales through the years, Help of this Site, how many people have you helped? Because of this site? Tips for Starting a Backyard Garden

Backyard-Garden.jpgStarting a vegetable garden in your backyard is a great way to save money and eat healthy. Gardening allows you to enjoy fresh, flavorful produce that is far superior to what you’ll find at the supermarket. Backyard gardening also helps reduce the environmental impact of transporting food.

Growing vegetables is a fun activity that you can share with your family. Gardening encourages you to spend more time outdoors, providing you with an escape from the stresses of daily life. In addition, a vegetable garden can transform your backyard into a more attractive landscape. Below are some tips for starting your own backyard garden from scratch.

Start Small

In your first year, don’t bite off more than you can chew because you could get overwhelmed. If you’re new to gardening, start off with a garden that’s no bigger than 8 x 10 feet. You don’t need a large space to create a plentiful garden. Many new gardeners get so excited that they plant more than they need and end up wasting food. Keep in mind that some plants, such as tomatoes, keep providing produce throughout the season, while other plants, like corn, produce only once. You may need to plant more of the latter type of vegetables.

Pick the Right Spot

A garden needs plenty of sun, good soil, and water to thrive. The plants in your garden need a minimum of five hours of direct sunlight each day. Choose a location for your garden that offers maximum continuous light. Make sure that you also take the shadows of trees, fences, buildings, and other tall objects into consideration when picking a spot. If your backyard lacks an area that’s fully exposed to the sun, you may still have success growing leafy vegetables like lettuce and spinach. Many gardeners like to have their garden close to their house, so they can easily step out and grab some produce while they’re cooking.

When looking for a spot for your garden, examine the soil. Most vegetables thrive in moist, well-drained soil that’s rich in organic matter. Garden soil needs to be well aerated to promote root growth. The best soil is crumbly rather than clumpy. You might need to bring in some topsoil or amend the soil with compost.

Your garden should be close to a source of water in case there is a dry spell and you need to water your plants. Avoid setting up your garden too close to a tree because the roots could spread. In addition, keep in mind that it is easier to garden on level ground than sloping ground.

Plan the Plot and Plant the Garden

Make a list of your favorite vegetables and consider the amount of produce that each plant can produce. When you’re starting out, stick with early-harvest vegetables that are resistant to diseases. Crops that are easy to grow include peas, beets, onions, and zucchini squash. Space plants in your garden according to the instructions on the seed packets.

It’s best to prepare a garden plan on paper. Plant in single-wide rows, staggered rows, blocks, or raised beds and include permanent paths. Be sure to plant tall crops on the north side of the garden, so they don’t block sunlight for low-growing crops. Use stakes, trellises, and other supports to grow twining crops like cucumber and tomato vertically and maximize the use of space.

It takes many hours to prepare for gardening season and get your garden ready, but it is well worth the time and effort. Eventually, it will be time to harvest your delicious garden vegetables. You’re sure to enjoy the experience of biting into fresh, crisp vegetables that you grew right in your own backyard!

My fellow Short Sale Superstars how many times can you shake your head? 5 and even 10 Short Sales(COMPLETED) Doesn't make you an Expert... agents are playing with someones biggest investment...and biggest loss; agents should know what you are doing when they take on a short sale, PERIOD...So again I hear the tale of a listing lost to a Very Good Agent...who sucked at short sales....by the time the potential client realized it...it was too late to re-list and get it sold....UUGGHHH

So the story goes of a great couple needing to complete a short sale with 1 lien(we all know how rare and what a dream it is to just have 1 lien)with Wells Fargo...mind you the agent originally taking the listing was well known in that area...BUT, that agent also knew my team...it was not long after taking the listing that the essential hardships of having a short sale starting popping up, paperwork, participation requests, title searches, etc., etc...so we know...that is truly when the Agents that aren't in the trenches with this stuff every day start to flounder...which happened here...

Where the client needs HELP and someone who can maneuver ins/outs of a short sale, can knock down doors and get this transaction done...A Short Sale Superstar...you know by now if you are one or not...I am not knocking anyone, we all have strengths in our job abilities...I say stick with those, Maybe you can wing showing luxury homes if your just a "newbie"...maybe you can get that listing even if you have never listed in that neighborhood before...BUT DON'T TAKE A SHORT SALE LISTING IF YOU TRULY HAVE RESERVATIONS ABOUT DOING THEM....

I'm happy to pay a referral, I'm happy to help be brought in on the deal...I am happy to help them, BUT THEY NEED YOUR EXPERTISE AND HELP, DIRECTION, KNOWLEDGE REGARDING POTENTIALLY LOSING THEIR HOME...

If you don't have that, move over...But do it before they call me and realize...IT WAS TOO LATE!

FHA Back to Work Program

Exciting News! FHA Is Allowing People that Suffered through Recent Economic Hardships to Apply for a Home Loan with the FHA Back to Work Program.

In the not so distant past people had to wait 3 years or more after suffering through a financial hardship. Bankruptcy, foreclosures and other major financial disasters would sideline people for a number of years before they could buy a house again. However, all that has changed with the FHA Back to Work Program.

Previous Guidelines

For years the FHA program has helped people finance the purchase of a home with a modest 3.25% down payment. In general, the FHA rules for credit and employment history were more forgiving than conventional loan guidelines. However, there were strict rules about waiting a significant length of time after filing bankruptcy, losing a home to foreclosure, getting a loan modification or a deed-in-lieu.

New Guidelines

The Back to Work program waives waiting periods based on certain hardship situations. People that have suffered through the following types of problems are no longer forced to wait multiple years to apply for an FHA loan

* Bankruptcy (either Chapter 7 or Chapter 13)

* Short sale of previous home

* Foreclosure

* Modification of previous mortgage

* Sale of a home due to pre-foreclosure status

* Deed-in-lieu

Due to the recession of the past few years the government has given FHA the ability to relax their rules in order to help people qualify for home loans. Now people will only have to wait 12 months.

Meeting the New Qualifications

For borrowers that have faced a hardship like the ones described above they will need to meet a few qualifications.

First the borrower will need to prove that their current financial condition is recovered from the impact of the financial hardship.

Second, the borrower will need to provide proof that their income declined by a minimum of 20% for 6 months or longer. This can usually be shown by presenting federal tax returns and the supporting W-2 forms.

Finally the borrower will have to agree to complete a counseling session aimed at educating home buyers.

In addition to these items the borrower must re-establish their credit. This does not mean that the scores must be 700+. However, once the hardship has ended the borrower will need to have good payment history on all credit accounts in order to prove that they are able and willing to make their monthly obligations.

Types of Borrowers

The Back to Work program can be used for people buying their first home as well as people buying their second, third, fourth, etc. home. It can also be used with the FHA 203(k) program for people that wish to renovate or modernize a home. Even people that are currently in a Chapter 13 plan could be approved for the FHA back to work program. The court will have to grant permission for the loan and the borrower will have to meet the other requirements.

The recent recession has hit a lot of people and left a lasting impact on them. The Back to Work program is aimed to help these people put the past behind them and return to the stability of owning a home.

Spend a Little Now to Get More Later

With so many homes available many buyers are seeking out a property that is move-in ready.  This means that small repairs and maintenance items will possibly turn off some buyers.  Take a walk through the home and pick out the small things that need to be fixed.  Leaking faucets, a chipped tile, a flaky bit of paint and other similar items can negatively impact the appearance of your home.

You should also consider spending a little money to get the carpets thoroughly cleaned and ask a local heating/air conditioning company to service your unit.

Put Yourself in the Shoes of the Buyer
