I will say that tweeting BofA Help works.  I finally have escallation on a file that was in the works for 9 months thru AMS.

Ava,

You've got your hands full! And sounds like complete lack of organization, integrity and communication on B of A's part (go figure). However.....just wanted to remind you and everyone that B of A / Recontrust (whomever) will continue towards foreclosure whether you have a bonafide offer and acceptance or not. We have to stay on top of this monthly and weekly and continue to get the sales postponed until COE. Granted your story is unique, but just saying....always monitor the sale and date. GOOD LUCK!

Thanks Joe, I'll try that and thank you Nina, I just sent that email.  My client called BOA to ask for the name of the attorney handling the foreclosure and they told her they did not know who that was.  I checked public records and got the info so I will be calling them.  The first time the sale was published in our area was 9/8/11 a full month after we submitted our offer.

Ava, contact the banks attorney.  They, unexpectedly, often will create a technical postponement for you.  Always a (pleasant!) surprise to me when it happens.  They seem to care a lot more about your client and the investor than the bank does - and/or maybe local P.R. for them?

Thanks Bernadette.  I just tweeted BOA help to see it that will help.  One of the problems is that the team lead has been involved and she is no help at all.  Going to send an email to Brian Monihan's office now.

Escalate to lead or supervisory level. Depending on who the investor is borrower may call and request a one time postponement. Don't wait, keep calling, you may eventually get to the right person who can help. Try going in thru another department for answers. I have been fortunate enough to be connected to the foreclosure technician who had the latest notes on the file. They were waiting to hear back from the investor. They did postpone and allowed the file to close. Hang in there.

I need help.   I have been working on a short sale since February we had an offer in March and received approval scheduled to close in June.  In may we discover that the appraisal came in lower than bank of america's asking price.  I went back to BOA to ask for a reduction in price and it took 30 plus days to get a response and the buyer walked.  In August we received a new offer and submitted in to Equator on 8/2/11 and it sat until Sept 2 in valuation status and I was told they were waiting on the BPO company.  I called everyday and sent them copies of the previous appraisal.  They did nothing.  Finally after sending numerous emails through equator they discovered our offer was within their guidlines.  They set a foreclosure date and  I have been told for the last two weeks that the approval is coming.  Now they are telling me that unless we can close by the 30th will not get the approval.  The lender haulted everything month when we did not have the approval letter.  I have a foreclosure set for 10-4-11 and BOA says they do not stop foreclosures in GA because they will have to restart the process.  What can I do?

I had same eperience with AMS. Had a HAFA short sale submitted in February. It took 3 months to get HAFA approval. Although I submitted it with an offer, they insisted that it wasn't. Anyway, BofA tweet helps a lot in escalating. Just got word yesterday that I will be getting the approval "soon", which can mean a long time again. Hopefully not! This file has been escalated so many times with AMS, but has still been very slow. Good Luck!

Brigitte, I rarely look at or comment on these general comment fields because it is such a mix of multiple messages - difficult to find threads and follow.  I suggest that you post your question separately because it is a relevant topic and will have both a fair amount of discussion and suggestions.

FNMA cares about nothing (bailed out now fed taxpayer black hole), AMS is hit and miss - you have to keep calling in about your issue - somtimes you get a rep who is also an "asset manager" and will help you. BOA uses HAFA sub-co's as whipping boys - no interest in helping, but you can push with a John Ciresi escalation and a call to the office of the president - and cross your fingers.
