FHA Contract Clause

"Sale is contingent upon the seller receiving prior written approval of Insert Name of Lender/Servicer."

FHA Listing Agreement Clause

“Seller may cancel this agreement prior to the ending date
of the listing period without advance notice to the broker, and
without payment of a commission or any other consideration if
the property is conveyed to the mortgage insurer or the mortgage
holder.” The sale completion is subject to approval (under HUD
guidelines) by the mortgagee.

Jennifer, I do not have an answer to your question, but I am trying to open up an FHA  short sale with B of A and am having difficulties getting that going.  I was told that the seller needed to send a letter requesting putting a stop to the loan mod that she has been trying to do with B of A for over a year, and to request the paperwork from them as well to do an FHA short sale.  They told her that they lost the letter she sent via email and then they said the lost the letter that she sent by fax, and then someone told her that her Realtor needs to request the paperwork, etc.  This is my first time doing an FHA short sale, but certainly not my first time working with B of A.  Any suggestions?

Trying to open a ticket with NSC, does anyone know or have any specific LOA. I do not hav the case number and was told it is slightly different than typical blanket LOA I use with lenders.

I've had WF tell me that their system wouldn't allow a variance request in a certain situations as well.  Incidentally I finally was able to get them to submit the request and I received the Short Sale Approval the other day.

On the conduct issue:  If the appraiser happens to be a Realtor, the Code of Ethics might be an option for you.  In the Phoenix market it's not uncommon to find an appraiser with a Real Estate license.

In an appraisal done for an FHA  short sale the appraiser made disparaging remarks about my firm and, I believe, appraised the home too high.  My lockbox system doesn't show that he ever even went in the home and he never contacted me for access.  I'm curious if anybody has any thoughts about how to dispute the appraisal based on conduct of the appraiser.  His comps were all within the subdivision but did not reflect the condition of the property.  Thoughts?

Funny thing when you contact Wells Fargo's CEO and other higher executives, those limitations seem to go away.

We have requested a variance. But in talking to my negotiator its a limitation in Wells Fargo's system, more than HUD not approving.
