FHA Contract Clause

"Sale is contingent upon the seller receiving prior written approval of Insert Name of Lender/Servicer."

FHA Listing Agreement Clause

“Seller may cancel this agreement prior to the ending date
of the listing period without advance notice to the broker, and
without payment of a commission or any other consideration if
the property is conveyed to the mortgage insurer or the mortgage
holder.” The sale completion is subject to approval (under HUD
guidelines) by the mortgagee.

Does anybody have Matt Martin's contact info (Director at HUD)?. I need to escalate on an FHA short sale with Bank of America. I currently have 3 FHA short sales with BAC and all 3 have been out of compliance and a total mess. I got 1 UC and I have a buyer ready to go on the other one but BAC is taking months to even issue an ATP. The offer was sent in to the bank on 2/6 along with the packet, the appraisal was done on 2/29 and no ATP yet. Offer meets the 86% net :) I have attempted to contact the negotiator, supervisor, manager and even the VP and their response was to allow them more time and we cannot afford to loose this buyer! Any help is greatly appreciated :)

I love working with BAC via EQ but FHA short sales take too long and theres not enough accountability for the reps, also phase 1 and 2 is very inefficient. Im looking forward to the day BAC works their FHA short sales on Equator.

I will get on my hands and knees for the phone number.  Send to me at [email protected] please.  If I have a better contact at Flagstar I won't mind helping someone out, but their process is archaic.  There is no reason why it should go thru so many levels and to think a buyer will just hang around for that long?  Meanwhile, the value of the property is going down, not up.  So, if you would Mike, please send me a contact number.  I would greatly appreciate it.

I did get a contact in the Office of the President who did return my call and hopefully we will start moving. I also escalated with HUD. I have stayed on top of them from the onset. Before I took it on I knew what I was getting myself into but I felt compelled to help her and now completely understand why she just wanted to walk away as they have been very difficult to deal with. Everyone in this forum has been very helpful and appreciate all the advice and opinions. You are not alone as most agents I talk to will not take on a Flagstar short sale but myself on the other hand will try and do anything if it helps someone out of an already bad situation.I will definitely keep everyone posted!

Flagstar taks a MINIMUM of 12 months to approve a short sale.  Find out who the Pres is and see what you can do to postpone the sale date. You will have to stay on top of them about the postponement of the sale date, but I'm afraid you just don't have enough time with this one.  I will never do another Flagstar short sale - they are the worst in the industry!  Best of luck to you and keep us posted!

I am working on a short sale with Flagstar and the sale date is 3/6/2012. I just had an offer signed off by seller but they are still reviewing retention options. I was told that a request was made to postpone sale for 30 days but not so sure what to do with the contract. Any advice?
