I have a short sale approval : Servicer of 1st lien is 1st United Bank, 2nd lien is Chase, investor is Credit Suisse First Boston LLC . Buyer could not perform on time. We asked for 1 more week extension. The extension was granted but the number  on the HUDs is changed. 1st lien want 9K more and they offer 2nd lien only 3K. Previous approval they offer 10K to 2nd lien.  Buyer signed docs and ready to fund but we cannot close because extension is not same as the original approval. Both lenders won't back down. I don't know what to do after 19 months in process dealing with lenders and IRS liens . Is there any way I can save this file from foreclosure ? Any help is appreciated .

Does anyone have any officer information at First Horizon? I am so frustrated with these people. Every time I call, it is something different. I've got a settlement from the second, which will go away if I cannot get anything from First Horizon soon. I've had the offer to both lenders in September.

Has anybody worked with Resurgent??? I have a client that did a stated income loan 4 years ago - they are now short selling. The second lender (Resurgent) is requesting the 06 and 07 taxes to see if there was income fraud. They are stating that even though we are in an Anti-Deficiancy State (Arizona), that they are going to pursue the deficiency since there was income fraud. I am curious if anyone else has experienced this. And if their clients have actually been pursued???

Hank, I have had this happen recently as well. Basically, the children can submit the request for a short sale with the following: death certificate, help from the estate or probate attorney, and also they have been named as the executor of the estae or it is a no go... Good luck :)

Hank, I have done estate short sales and recently had one that one of the sellers died. You will need to supply death certificate and any estate/probate docs along with the short sale package

Help...
My client listed his investment property with us as a "short sale". We received a couple a couple of offers but before they could accept the offer...both my client and his wife died in a tragic automobile accident. The adult children would like to move forward with the sale.
Any ideas/strategies in approaching the Bank regarding the 'short sale'?
Thanks for your help.

Please help!!! God I hate Ocwen got an approval on Sept. 21, Property was going up for auction on Oct 7, so the approval was only good through that date. So I go to court and get a 30 day extention. I then go back to Ocwen with the extention get a new approval within 72 hr. great I get an appraisal title survey everything is ready to close ecept when title agent does lien search we have a shed violation with a lien of $10,590.00 ouch... I go back to Ocwen to negotiate the lien and they say they will not pay it so I ask for 15 days to negotiate the lien with the county and Ocwen tells me flat out no. So I am now at the point were the borrower has filed BK to stop the auction. I send the suggestion of BK to my negotiator at Ocwen and now he tells me to call him when the BK is released to start Negotiations again. I am going crazy with this deal already..... Any help would be greatly appreciated.
