12. Flagstar Bank, F.S.B., Troy, MI [Docket No. 12-1436-MR]

Action: On November 21, 2012, the Board entered into a Settlement Agreement with Flagstar Bank, F.S.B. (Flagstar) that required Flagstar to pay a civil money penalty in the amount of $37,000, and pay $92,677 to indemnify HUD for its losses with respect to one FHA loan, to indemnify HUD for any loss (past, present or future) on five FHA loans for a period of five years from the date of the agreement, and to retain and fully pay for a third-party servicing monitor for a period of one year, without admitting fault or liability.

Cause: The Board took this action based on the following violations of HUD/FHA requirements alleged by HUD: Flagstar failed to engage in loss mitigation, failed to service FHA loans in accordance with HUD requirements, and failed to offer property disposition options to the mortgagors.

For those of you that have actually closed a short sale with Flagstar....From the time you received the email counter, how long did it take to receive the approval letter?  I received the email counter offer and all it said to do was send back an addenum & a revised HUD, if the buyer accepts.

Be firm let them know you will be calling the investor and the trustee anyone else that will listen and help to get this call.  The "service personel" on the phone do not care.  Make your call and tell them and they will document the file.  Call every day and then if you don't hear back on day 3 call them again and let them know you ARE CALLING THE INVESTOR THAT DAY. You have to call all these parties with Flagstar because they don't care - only when you make enough waves.  If you still don't get help email me off site.

Flagstar requirement: Seller must wait for a "welcome call" from Flagstar before they can call in??? I have the buyer, another agent has the listing. We have been waiting for this "phone call" for a month. The agent says she called today, and they are stuck in a holding pattern and told to be "patient" as the "phone call" will come (get this-in another 2 weeks). Anyone heard of this? I could use some contact information to make some calls myself.

Since Flagstars process is soooo slow I started with the 2nd lender who is Chase. At first Chase did not want to move ahead since they needed Flagstars approval but I asked and pleaded that if we can get an approval from Chase first then Flagstar will start moving. Got my approval from Chase today and they are willing to take $3000 from Flagstar to release the lien. I sent this to Flagstar and now they are trying to get this to move faster. Still remains to be seen but at least I got the 2nd approved. I have been working on this Short Sale for 4 months. Keep you posted.

Please let us know what happens.  I have my first offer to submit to them and have read nothing but unfavorable comments about them. Does anyone else have an initial approach that has worked for them?

I contacted my Senator's office on Thursday, they will be contacting Flagstar on my clients behalf, I will update everyone once I know what happens!
