YAY, received approval from Wells on the first and BofA on the second today!  Offer was submitted in Sept.  Investor took so long, the negotiator at WF actually escalated it.  In his email to me, he wrote, "I know sometimes it feels like we do not say it enough, thank you for your patience in getting this short sale approved.".  I thought it was a nice note to send.  I had a very responsive negotiator that tried to move as quickly as he could.

Jeff and Thom - Thank you for your answers. Today the Seller received the approval letter, which was mailed directly to her from a different person than I've been speaking to and it was 3 pages long and DID waive the deficiency. This doesn't mean negotiators lie, does it? :-) At least all is well now.

Karyl, I would talk to an attorney but I can not see how Wells can attach a deficiency if they are not legally allowed to in your state.

Heather - I undertand how frustrating it can be on the Buyer's side.  But barring the Seller authorizing you to speak with the bank, there's really nothing that can be done.

We do have an executed contract, my client did most of their due diligence because we were told by the agent we were in.  In Utah we have a short sale contract that goes with every short sale offer ever written that does state nothing is binding until lender approval, so unfortuantely a seller could sign more than one contract.  I know I couldn't speak to a supervisor but the sellers agent and their atty seem willing to help us if we can replace the approval with this offer, they just don't want to be out two months, because it is a VA the seller has been making payments the whole time.

It is strange, my client felt we were lied to and our offer wasn't ever submitted, as by submitted another offer wouldn't Wells ask if the previous offer was cancelled?  They had previous asked if the first offer would go up to 329K and we were told they said no, but here is a new offer that is willing and were told our offer was submitted.  Now I'm not sure if our offer was submitted or not??  The counter does say there is multiple offers to the first offer?  The whole things is so frustrating especially because we are willing to pay what they wanted.  No one has a supervisor or something for Wells Fargo that we can plead our case to??

We realize that was the screw up when the attorney/agent said our contract was in, yes they forwarded our contract, but they didn't cancel the previous contract....
