12. Flagstar Bank, F.S.B., Troy, MI [Docket No. 12-1436-MR]

Action: On November 21, 2012, the Board entered into a Settlement Agreement with Flagstar Bank, F.S.B. (Flagstar) that required Flagstar to pay a civil money penalty in the amount of $37,000, and pay $92,677 to indemnify HUD for its losses with respect to one FHA loan, to indemnify HUD for any loss (past, present or future) on five FHA loans for a period of five years from the date of the agreement, and to retain and fully pay for a third-party servicing monitor for a period of one year, without admitting fault or liability.

Cause: The Board took this action based on the following violations of HUD/FHA requirements alleged by HUD: Flagstar failed to engage in loss mitigation, failed to service FHA loans in accordance with HUD requirements, and failed to offer property disposition options to the mortgagors.

After holding for nearly an hour, someone answered the phone and asked if I had the direct line to loss mitigation. It is 800 393 4887. They have numerous job adds for loss mitigation at indeed.com so I guess they are trying. Three years too late.

Does anyone have a phone # and contact in order to escalate a file?   My short sale has been negotiated by an attorney, and they are also getting the run around.  The attorney is ready to file a complaint with better business burea, but that doesn't solve the problem for my client.

Anyone have suggestions?   This is the second offer and it's been 6 months (with the other offer totally 16 months now).  Flagstar is postponing forclosure date, 1 week at a time now.   Geesh...creating more work for us and Flagstar.  Makes no sense.

I think we should get a letter out to the CEO's at Flagstar and the media in our area's. This is ridiculous. They are soooo slow and are not up to par on the process of the short sale. Alot of you probably know that they go by the status of the account. If there is a NOS they would work on those first etc. They do not have enough staff to take care of all the foreclosures. So that being said I am going to write a letter and get it out to all of you. If you have any comments please let me know and I can add to the letter or you can add them as well. We need to get them rolling on this. Flagstar, ING, Indymac are just a few that are not on board. They need to get on Equator in my opinion. You can e-mail me at [email protected] or 415-368-3643.

I have been short sales for the past 4 years and this is my first with Flagstar. Looks like most of us are having issues and a few have closed. I submitted my whole package in March and I do have a negetiator who has not reached out to me yet. So far they are pretty nice over the phone and seem to want to get the process going. Still remains to be seen. They have told me that it will take 60 days so I'll keep you posted with my success. If I get any new information as to new numbers so we can escalate our files I will put them up for all of us. We are in this together and I try to be there for all my fellow realtors ! Dont' give up !

Ben- I emailed you (think the one u wrote on the wall is wrong), hopefully I can get this pointed in the right direction. I just hope my realtor is actually doing all this already and not wasting my time.

Jon - find out who the "Investor" is on the loan and contact THEM directly....this will resolve your problem.

Youc an use a form known as a "QWR" or, qualifed written request (e-mail me directly at [email protected] for a copy)

Find this information out for ALL of your short sales (as well as teh MI company and their contact info) and your closing percentages will GREATLY icnrease, and, your average time to close for short sales will drop dramatically.

I'm still trying to get a definite awnser myself but to no avail. My realtors already got in contact with the CEO's office a few months ago and it looks like it didnt help.

In the end I think if you cant afford to play the waiting game dont waste your time. I'm stuck living with the in-laws for the time being and being bull headed wont let me give up lol.

I'm new to this site and have had an offer in on a short sale thru Flagstar for about two months. In reading most of these posts it i becoming clear that I am probably wasting my time. We are active military and have given our landlord notice that we will move by 1 July. It seems as though our assumption that 90 days or so would be adequate based on what the sellers realtor was telling us when we made the offer. Does anyone have any suggestions on getting a definitive status out of Flagstar? Looks like folks have had a variety of experiences with escalating up the management chain. Great discussions though, thanks.

I'm 6 months deep with trying to buy a short sale from Flagstar. Is there any contact info past the 2 numbers above that would help? I'm at the point where I want to tagteam this with my realtor. Thanks for any help!
