12. Flagstar Bank, F.S.B., Troy, MI [Docket No. 12-1436-MR]

Action: On November 21, 2012, the Board entered into a Settlement Agreement with Flagstar Bank, F.S.B. (Flagstar) that required Flagstar to pay a civil money penalty in the amount of $37,000, and pay $92,677 to indemnify HUD for its losses with respect to one FHA loan, to indemnify HUD for any loss (past, present or future) on five FHA loans for a period of five years from the date of the agreement, and to retain and fully pay for a third-party servicing monitor for a period of one year, without admitting fault or liability.

Cause: The Board took this action based on the following violations of HUD/FHA requirements alleged by HUD: Flagstar failed to engage in loss mitigation, failed to service FHA loans in accordance with HUD requirements, and failed to offer property disposition options to the mortgagors.

After 17 months and 3 buyers my short sale with Flagstar closed and recorded on Tuesday. Yeah!! A very important short sale deal because my Sellers are active military and he would have lost his security clearance and some benefits.

I've been hearing rumors about Carrington Mortgatge merging, or selling loans off, on some level with Flagstar as soon as April 15. Can anyone confirm this?

Kari,don't be afraid to call often, or else you will fall into the black hole. If you're lucky enough to communicate with someone that gives a darn,then consider yourself one of the chosen few. You must be very thorough in the package you send Flagstar or they will use every excuse to put you at the bottom of the heap.Take care and God help you,you're going to need it.

Lynne - That is some of the best information I have received in a long time.  Thanks for sharing that phone number!

 

Michael - You are giving some hope that this short sale I am working on will close.  I hope that I won't come even close to the "black hole."  I was just told that my new short sale will be "in review" for 3 - 4 months and only will be looked at if my sellers are in foreclosure.  I mentioned that Flagstar must be overwhelmed by short sales right now and she commented that they get about 145 files a day! What the...  other banks receive thousands a day and have better follow up than this.  I am going to follow up with the phone number 800-945-9951!

Lynne,by the grace of God you hit pay dirt it sounds like.

  I'm happy to report that after 51/2 months of having an iron clad short sale package ready to close,it finally happen last week. Everyone,including the title company,just cried afterward,it was a hard fought battle with good ole Flagstar. I can't believe it has finally closed,boy, what an experience,I should write a book about it.

I feel like I've won the lottery......direct extension to loss mitigation (not customer service) is 9951.  No more talking to a cust service rep that only has the authority to say "the file is in review".

Tara,Congratulations,you have just fallen into the Flagstar black hole. We have had a completed package into then since early Oct. and they keep saying every Friday that it's under review. I have no use for Flagstar at all, and how they remain in business is beyond me. I have never dealt with another lender like Flagstar,nobody there wants to take responsibility for an approval.
