I couldn't believe it when it happened, but it's true.  After not getting a call back from the mitigation department for 3 weeks and I called and left messages EVERY DAY (on an 18 month old deal) I contacted the escalation department.  After speaking with the woman that opened a file for me in escalation, I received a call THE NEXT DAY from mitigation.  I was trying to let them know I had a counter offer.

The supervisor that called me back was P.O'd at me for even thinking about contacting the escalation department.  She let me know........

"...under no circumstances are you to contact the escalation department again regarding this deal.  IF YOU DO I WILL PULL THE PLUG ON THIS DEAL!  Do you understand me?!  You WILL NOT see this to close!  This thing will be DONE!  I will make sure you go to foreclosure if you go over my head EVER AGAIN!  Do you understand?!"

People........ I am NOT kidding.

So, I see we have finally reached a point where the banks who receive TARP money believe they can do and say anything they want to without any recourse, accountability, or responsibility.  INSANITY has entered the building and COMMON SENSE has left.

Don't assume you'll get common courtesy here.....  it's non-existent.

I am considering going to the media with this one.  What would you do?

Find out the investor ( good luck) and get the investors contact information and email this to them!
This is ridiculous! Go to the media and get the word out, you'll be doing your client and everyone else a favor.
How about the OCC too!
I would call the dummy back that threatened you and "pretend" to be your boss or broker, try to play nice and record the call if you have the capacity.

ALWAYS try to get the name of the person you are speaking to prior ANY discussions....also, we use their line when convenient:

"this call may be recorded for quality assurance purposes...."

If it were me, I would go RIGHT BACK to the escalation department and tell them what you just wrote to us here.....I would ABSOLUTELY request a new negotiator be assigned to my case as well.....

One good thing, ESCALATING OBVIOUSLY WORKS AND DOES RUFFLE FEATHERS......
I would follow Ben's advice.......I would first go back to the escalation dept and tell them what transpired.
If no satisfaction from that I would let the media know as well as send this to your local congressional and senate representatives.

Well Jodie...GREAT NEWS for you! Your deal suddenly becomes the deal that needs to go away as viewed by their legal department. Escalate again and play the legal card, on their end. If the negotiator calls you on it, remember you need names times and what was approximately said. Call their legal department and politely ask them, "What is the procedure one takes, when during the course of normal negotiations, they are threatened by a Chase employee?" Sit back, play it like a poker hand and reveal only info they ask for and be brief. You should now be in a much better position (after the matter is addressed) to get this deal closed. You will be contacted by a supervisor or better to which you should take the opportunity to negotiate the deal for the better and a move to close rather than do the "he said, she said" discussion. Call the Executive Office 800 242 7399 ex 51968 . That is James Diamon's, CEO, office. If you can speak to Roger Conner, Executive Assistant, you will get the help you need. They will assign someone to monitor the file with you. All communication you send to the negotiator can be cc'd to them. Or send an email with this story to [email protected] ATTN: Roger Conner. I was able to actually close a difficult short sale(1st and 2nd) with their assistance. Yes Insanity has been ruling for some time, but I'm not sure Common Sense has ever been present!

Thank you, everyone, for great information and great support. After speaking with my broker, I calmed down quite a bit. Not that I believe we, as Realtors out there working diligently to make this a better market, should EVER have to deal with such abuse. But, we are also the ones that are in the trenches, so we should become better equipped (or at least I should) to handle the warfare. I'll admit it, I let this woman's rudeness get to me. That, in and of itself bothers me.

Anyway, I have decided that as long as I'm receiving information I need from them in order to continue forward, I will NOT go to the press. After all of that craziness, the supervisor did give me a counter-offer to go back to the first lien holder with. So, I'm playing on BoA's field once again. They're not pleasant either.

In the meantime, I'm going to take time to sit down and write my Congressman about this incident, as well as any other governmental official I can get attention from in a decent amount of time. The OCC is a great idea! I'm also going to let Chase's upper management (Dimon, etc.) know that I'm letting the government know what I've (we've) been dealing with.

For me, it's not just about MY deal. It's the bigger picture. This may sound corny but:
Both my grandfathers fought in WWII (Navy and Marine Corps). I have a great uncle that died at sea on the USS Indianapolis after delivering the Atom Bomb to end the war with Japan. That ship, if you don't know the story, was torpedoed by a Japanese sub and the men were left to be eaten by sharks (which took a week). My father was a Marine. I don't take this country or the things that happen to Americans lightly. I am with the USO and support our troops all over the world today. WE AS AMERICANS should not stand for any corporation to behave in this manner. It goes against EVERYTHING we stand for in the US. I am ashamed and appalled that it has come to this. And, I believe, it is time it ends. (Did the baby boomers do too many drugs in the 60's? Seriously.) Sorry, I'm a Gen-Xer, and that's not saying much either because we are far too apathetic.

Every day I am inspired by the people I serve to continue prospering in the American Dream of owning a piece of this rock we call USA. We are Americans. We think outside the box. We find a way. We work towards our goals. We help those that cannot help themselves. We believe in freedom and protecting those who don't have the rights to protect themselves. We are Americans. I believe corporations like Chase, Bank of America, BP oil company, etc. have forgotten ALL of that. (BP, although not an American company should know WHO they are dealing with... Americans.)
