Tara, In the 1100 section of the HUD, I add a line item call "Atty fee" and add the amount there on the seller side. Now, Chase won't allow it in non-atty states (such as VA), but I was just able to get them to compromise and move a portion of that fee  up and add it to the settlement fee. It's not an ideal situation, but it was better than nothing.

What does Chase cap their borrower paid closing costs at? Is 3% the max or have they gone higher?  Thanks!

@Sara - Sometimes they will accept just one borrower's authorization when there are multiple parties. If it makes it expedient, and the other parties are difficult to track down, give it a try. Re your second question - you need to submit the contract and immediately escalate the file to get their attention and put a hault on the sale.

Separate question-- has anyone ever had a situation with a property that has a foreclosure sale date on it or may be close to the lender putting a sale date on it BUT the property may sell with the lender being paid in full. How have you been able to get lender to allow time to close sale before foreclosure? Thanks.

More than one person is on mortgage. I know that we need everyone that is on the loan to provide info etc for the short sale to take place, however, is one borrowers name and signature on the authorization enough to start?

1st & 2nd w/Chase... received 1st's approval letter.  It states the letter is for release of lien only and the homeowner is responsible for all deficiency balances.  They also reduced commission to 5%.  Any tips on how to get them to remove the deficiency verbage and raise the commission?  Any info is appreciated.  Thanks! :)

Does anyone have a contact at Chase regarding the Arms Length affidavit that has been modified with the new Freddie Mac terms? Our Chase department refuses to update their affidavit to include the new criteria.
