Difficulties with a Chase file.  Our file was in equator, got booted out once then I called and they put it back in.  Now it's booted out again and Chase won't give me any information other than the loan is still theirs and it's being transferred to another dept!  What dept?  They won't tell me.  What is going on?  Appraisal is complete and bpo is complete.  Why are they being so secretive?  Even the homeowner called and they won't say.  help!

If you're in California, there is no deficiency to the seller. Other states, though, I do not know.

David,

   If the file goes through HAFA they will pay 6%. Depending on the purchase price and investor they could cut commissions, if the purchase price is under 700k, they typically will give 6%. Once it starts getting closing to a million dollar listing they will typically only give 5%. Many agents like to play dual agency on the safe side and  have an agent in their office represent the buyer to prevent any potential cuts in commission that otherwise could of been avoided.

What is chase's policy regarding dual agency in a Short Sale?  Will they pay full commission to both agents from the same firm?  Full commission for the same agent with both sides of the transaction?

Hi June,

I have the exact same issue going on. They tell me that there were delays in Jan 2014 while they were getting the systems set-up for delgated authority on USDA files.  For USDA contacts See: https://usdalinc.sc.egov.usda.gov/docs/rd/sfh/lossclaim/ServicingCo... 

Send an authorization and explain Chase's failure to mitigate.  You should hopefully hear soon. Also, I would escalate within Chase. Good luck!

Hi all, I have a short sale contract in with Chase and we are waiting for USDA approval.  The contract meets the ATP and has been at USDA since the middle of Dec. 2013.  Does anyone have a good contact at USDA? I've tried escalating at Chase and hit a brick wall. I appreciate any ideas!

Marcus,

     First whoever is facilitating this transaction needs to find out if a value dispute is an option. Depending on the type of transaction, the servicer may or may not order another appraisal. More than likely, a value dispute package would need to be put together. This would consist of a CMA or an appraisal, colored photos, repair bids or any additional supporting documents. We typically suggest two different licensed contractor repair bids  are completed as if you only have one completed, the bank may discount it's validity. Having a 25% price reduction for a value dispute outcome is never guaranteed, but it may be worth looking into.

Brett - thank you very much for the prompt response.

I am not sure who the investor is on the loan.  I can try to find that out if it is helpful.  

There are significant repairs needed - and cosmetic repairs as well.  There is a hole in the floor caused by water damage and now has mold around it.  Someone told me that the mere mention of mold typically scares Chase pretty good.  Does a value dispute require my to obtain the 2 repair bids and an appraisal, or is this done by Chase?  I assume that this would be on my dime. I am getting one bid, but can work on a second if you think it is advisable.
