Seller concessions - $1900
Total Closing Fees for buyer $4500
House appraised higher that approved price so the buyer is getting a loan that covers all of his costs (new loan higher that approved sales price)
As I have seen in many listings, and possibly the one Marcia's is related to, where the listing agent states...."Buyer must pay a negotiator fee" I don't believe a buyer simply goes out and looks to find a short sale negotiator
I am confused now.
How much are you asking for the seller to pay for buyer ?
Tony, it can be depending.... so if I hire an attorney to review my contracts it has to be on the HUD?
The buyer is 100% financed so the $1500 is in their loan
Buyer is bringing $0 to closing
Agents only getting total $3000 commission (very small purchase price) so they won't pay
Buyers new lender won't let buyers pay outside of HUD as it is in the purchase agreement and this is skirting RESPA to remove (and they would have to redo GFE and wait 10 days in which time approval letter will expire)
Wow Jeff be careful with that advice. paying anything outside of escrow is Fraud!
Well there you go The banks, CHASE, aren't stupid, They know that credit is going to the negotiation fee. And if the buyer has $1,500.00 to pay the negotiator then they do not need to $1,900.00 concession. Simple answer.. agents pay the fee.
Take the neg fee off the HUD and have them pay it outside of closing.
Marcia they are now seeing that there are seller concessions (probably overlooked it) and they wont allow the fees for a negotiator if there are seller concessions. Just my guess... they are not seeing the entire picture
The buyers hired a lawyer/neg. team to neg their short sale and it was in the purchase agreement that the buyers would pay $1500
There was $1900 in seller concessions allowed and the buyers fees are $4500 so $3000 without the neg fee that can be paid for with the concessions
Approval letter was issues with Chase knowing all of this - nothing was hidden from them and now Chase closer is saying that the buyers can not pay any fees does not matter is lawyer or neg. fee
When did the banks get to start dictating what a buyer pays for?
We had Chase escalation on this but just got the run around being told to work with our closer
