The simplest way that I have defined it is that a short sale arises when the total costs associated with the sale of real estate including, but not limited to, the payment of all outstanding mortgage(s), taxes, real estate commissions and other liens exceeds the amount of the proceeds from the sale AND, the existing lender(s) or mortgage holder(s) agree, based on the borrower/property owner meeting certain requirements, to accept a payoff that is less than the balance due in order that the home can be sold/closed.
