Hi have a FHA short sale and Wells keeps procrastinating on the APT

they keep ordering appraisals and now I get a "is there an offer ( foreclosure warning)  the customer service is not customer service.

I need to escalate can anyone help with a contact ?

I would just concentrate on obtaining a Fair Market Value offer for the time being.

  • No servicer may initiate foreclosure until their senior management committee has reviewed the loss mitigation analysis and determined that the borrower does not qualify for any option.
  • Servicers must offer loss mitigation throughout the foreclosure process any time the borrower requests such consideration or the servicer becomes aware that the borrower’s financial situation may have improved and assistance is now an option.

I've had offers both before and after the ATP's were issued.

Gina,

That's totally incorrect information you've received from both HUD and Wells Fargo.  Almost every single (and there have been quite a few) FHA PFS I have worked and closed have been in Foreclosure yet an ATP was issued.

Sandy  thank you for you post.

I did get a hold of HUD and got a ticket number. Hud called me back within 30 minutes and the problem  HUD said they will not issue a ATP  with out an offer, if the property is in foreclosure, I did have an offer and Wells would not send the  ATP  I think one was issued but never got out of Wells. Now everyone is back peddling. the buyer walked and now I'm scrambling to get a new buyer.....eeks !

Hopefully this will help you- I am having major issues with Everhome bank and FHA short sales and what I did was get HUD involved.  Call 877-622-8525 you will need the sellers FHA case # which will be on the ATP. They will also send you an Auth. I have also contacted @ Wells Fargo the Office of Executive Complaint for Mortgages: 800-853-8516.  Perhaps someone there can get assigned to the case and help you out.

Yes  I started in November and Wells kicked out the file in January and from that time I'm in equator.
