Wachovia has foreclosed! Changed rules in the middle of the game..dirty pool

My Wachovia Fast Track Short Sale listing, with accepted offer, was foreclosed on 8/10 despite written assurance from the asset manager that they would not foreclose. I had that happen to us once but since we are in a judicial state we can contest a foreclosure within the first 10 days. The homeowner filed for an emergency hearing, the judge reversed the foreclosure action upon seeing the approval letter, and bank's correspondence. In the future make sure you fax the bank's lawyers requesting them to make sure the foreclosure is cancelled before hand, send them the approval letter etc, request a confirmation that foreclosure has been cancelled, it is less work for them in the long run if they know it will be contested in the first 10 days.
