Short sale on property where a refinance was done to get spouse name off property

I have a client that we are considering taking on in a short sale. The situation is that the couple went thru a divorce. He refinances the property to get the spouse off the mortgage. Since then he had a medical issue and he was unable to work. He is three months behind on the mortgage and wants to sell the property. Does he qualify for a non-recourse short sale?

Why wouldn't he? I think he definitely does.
