I have a listing and have submitted an offer, I have received several back up offers. One Agent today is asking - insisting "Will this offer be signed off as a back up. Please submit asap".
I had replied to her "offer received will keep as a back up offer and will advise. I spoke to her today and she states she always requests for seller's to sign off on her back up offers, this ensures the investor/buyer his offer will be considered. Need to know the legalities any insight information will be greatly appreciated.

Not in my state. I can have a seller sign a BACK UP, but it won't be submitted to the lender unless the first sale goes dead in the water. The seller can "consider" the offer all day long, but the first offer signed and submitted to the lender is the one I work on. If it doesn't come to fruition I THEN send in the back up offer.
hmmm....how can a seller sign two contracts?
