I am hoping for your feedback and suggestions. 

 

I submitted an offer to BofA on my short sale listing - Just a little back ground info:  2nd offer on the property, higher than the 1st offer.  1st offer was not declined, buyer walked after 9 months and 2 bpo's.  2nd offer was only higher because we had multiple offers this time.

 

They are using the 2nd bpo since it is less than 90 days old.  I received a counter offer today.  They are not countering the purchase price or commissions. They are asking my seller to put $1500 cash down and sign a promissory note for $10,000.  My seller has no money, is digging a deeper hole of debt every month as she had to move out of the area to find a job, a very part time job.  She is not making enough money to make ends meet now, she has stopped paying her mortgage altogether because she can't afford rent and mortgage.  If she signs the promissory note for $10,000 and actually pays it, BofA will be getting more money than her current payoff. 

 

Now for my question - has anyone had any luck negotiating the promissory note with B of A?  How did things go?  How long did they take to respond to your counter?  Any other useful info for me??

I negotiated the prom. note away by telling the negotiator to go back to the Buyer's Financial Statement and review the fact that they don't have the money. And they said OK and dropped the prom. note!

Sounds like it might be MI. Do you know if it is? If so, they are next to impossible to deal with, in my experience. If it's coming from B of A, I've heard they'll negotiate that down but I haven't actually had to deal with that situation myself. Good luck!
