Short Sale Denied

I have a 2 family home that is condemned and is in need of over $60,000 of repairs. Ocwen says homes valuation came in at $65,000 but appraiser did not view the whole house because it was not safe. My buyer's offer is $50,000. I've informed Ocwen that because the house is vacant it will be rezoned as a single family and in the condition that it is in they will not get $50,000 as a single family. Property also has violations. Should I try to reach out to the investor directly?See More

I need some guidance please. I have cash buyers who offered $50,000 for a two family condemned and uninhabitable property. Originally OCWEN wanted the buyers to increase their offer to $67,000 based on a drive by valuation. I proceeded to inform OCWEN that the property has been condemned and uninhabitable per the City.  I've sent them pictures of the outside of the property and the posted condemned notice. "Must waive now. You will get a 1099 regardless. A short sale is a taxable event. It has nothing to do with the lender waiving the deficiency. You may not owe any taxes though. speak to a tax professional."

"Yes, perfectly normal. The BK has no effect on this, as it releases the personal debt but has no effect on the lien. The lien release is Ocwen's only chance to collect any money. It's a normal short sale."

My client has filed for chapter 7 and was discharged.  I tried to get a lien release from Ocwen but they won't even discuss this.  They want a portion of that sale and primary bank is not getting that much to begin with. Is this normal practice? Any way around it?See More

BOA BIG Mixup

I have a client who purchased her home with a BOA financing. A year later she applied for a home equity again thru BOA. BOA sold the home equity to Ameristar. Simple enough, BOA is the primary, Ameristar is the secondary. Well no, apparently when she applied for the home equity, BOA somehow made that the primary making the primary secondary. Now she is doing a short sale. How do I figure this out for sure?

Does anyone know if there is a way to find out if a bank will waive the difference on a balance owed from a short sale? Are there any banks that absolutely will not waive it and send a client a 1099?

Short sale and divorce

I have a divorced couple doing a short sale. They are both very cooperative. Banks aren't. The wife went back to her maiden name and banks will not accept her authorization with her signature under the maiden name. I can get her to sign in her maiden name but will her docs such as filed taxes and pay stubs be an issue. I already have buyers who really want this home.
