I hope someone can help me. My mortgage servicer is Carrington. I am currently am in the SS process got a contract and now just waiting for their counter, refusal or acceptance. I have been asking all throughout the process that I would like this to be a HAFA SS (as I qualify) but my lawyer, re agent and mortgage bank have been less than helpful. Is there anything I can do to insure the relocation fees. If I don't get the relocation fees it would in effect put us out in the street. Any help would be appreciated.

You should call your servicer and ask if you're eligible for HAFA. You should ask for a copy of the settlement statement sent to the bank, to ensure they are asking for HAFA. What type of loan did you use to purchase your home? If it's a government loan, you won't qualify for HAFA but potentially a lower and different incentive.

It's not a government loan. I have tried to call the bank they keep stonewalling me giving me all kind of answers and no cooperation. My lawyer doesn't want to get involved and the RE Agent is clueless. I am also going to assume that the settlement statement will not have the relocation fees as she believes that it's completely up to the bank.

Why are you working with a Realtor who is clueless about short sales?
You should express your concerns to your Realtor, if it does not seem like they are getting it, escalate to the office manager or broker. Working with an experienced Realtor can make the difference between getting your short sale approved and the bank foreclosing.
