You have to counter back thru Equator, however I've had similar cases where the buyer did not make any changes to the counter and BOA rejected the counter. See if the buyer is willing meet BOA half way.
I had a listing for $225K, and got and offer for $190K cash, I knew it would get countered. Sure enough the BPO came in at $228K and BOA countered at that price. The buyers re-countered at $215K and BOA accept it.
Of all the short sales I've had approved, they have never made the seller sign a promissory note, they have all been owner occupied.
