@Matthew Is this a standard sale or a short sale? What sort of relief are you looking for from the servicer for while you sell his home? Is he looking to stay current while you sell?

I have a client who's been good on his payments. He's federal law enforcement though and caught a double wammie. His wife left him and took a large chunk of his finances, and he was put on furlough without pay for an extended period of time. The home is also listed for sale for which we hope to have a buyer in the next few weeks, however, he may be missing payments before we can close it out. He's VERY short on finances and possibly not able to make future payments. He's contacted M&T only to get the cold shoulder. Whom should he reach out to for some relief?

For anyone who is just looking into this lender, I just had them go from faxing a package to ordering the appraisal, to telling me they would issue an approval in 3 weeks.  It's been another 11 days since they said the approval letter was coming so that's been annoying, but this has to be the fastest approval I've ever had with a 1st mortgage. Don't be afraid :) I will be looking for more M&T short sales in the future

Rebecca, that helps to know that's possibly going to be on the approval.  And Chad, that helps knowing it might NOT be on there too! I sure wish they would issue it :) it's been over 11 days since they last responded to an email we sent, and we've sent many, and I can't figure out how to escalate this...

Does anyone have an M&T Escalation name/email/Phone number? All we can get is the negotiator's email address but she won't respond for a week now...

Don't know if this helps, but it is the only deed reference in the approval letter we received on the $66,000 FHA M&T short sale of a condo in Baltimore County, MD.

5. The deed conveying the property to the purchaser must be amended in compliance with applicable state law, to include the following provision:

Version 11/2014

Grantee herein is prohibited from conveying captioned property for any sales for a period of thirty (30) days from the date of this deed. After this thirty (30) day period, Grantee is further prohibited from conveying the property for a sales price greater than $82,500.00 until ninety (90) days from the date of this deed. These restrictions shall run with the land are not personal to the Grantee.

Neil, FHA does not require any deed restrictions at settlement. We have not had any M&T FHA files include a deed restriction. Chad.

Items needed for M&T short sale:

A proprietary M&T Short Sale Package can be found here: https://www.mtb.com/customerservice/Documents/Foreclosure-Preventio... (if link doesn't work it's on this page)

The following documents are required for the short sale:

  1. Authorization (Generic is OK)
  2. HUD1
  3. Contract
  4. 3 months bank statements
  5. 30 days Paystubs or if self employed, 3 month profit/loss
  6. Hardship Letter
  7. 4506t
  8. Listing agreement
  9. M&T Financial information form (MUST BE THEIR FORM)
  10. 2nd lien form (MUST BE THEIRS)

NOTE: Tax returns are NOT required. the 4506t is sufficient

If the loan is owned by FannieMae or FreddieMac, the Uniform Borrowers Assistance Form is required as well.
