I am a buyer in an Ocwen short sale in Suffolk County, NY.  Next week will be 4 months since the contract of sale was signed. The SS package was sent about a week later. My lawyer or agent can't get any specific answers from the sellers broker or attorney on the progress.  All we get is "we are working on it and it is progressing"

From what I can tell the sellers attorney specializes in residential real estate and has experience in short sales, from both seller and buyer.  How successful they have been I don't know.

About a month ago they asked me to sign an arms length agreement, 3 weeks ago they wanted an recent POF (I am all cash) and 2 weeks ago had me sign an extension to the closing date to July 15 as the original was about May 15th.  I would assume these are positive signs.

I saw a few weeks ago Kathy Robinson, Sr Mgr of SS at Ocwen posted that people call her instead of Ron Ferris.  As a buyer I know she can't give me any specific information but was thinking of calling her anyway. Is that a bad idea?

Any suggestions would be appreciated.

It is unfortunate that the short sale negotiator won't give you any details on the progress of the short sale - that is not how I operate as a 3rd party negotiator; but on the bright side, it sounds like you are making progress as the documents you have been providing/signing are all signs that the short sale is moving forward.  It would not do you any good to call Ocwen as you are not authorized by the seller to get information about the short sale.  Ocwen has greatly improved its service so I am surprised it has taken four months to get this far.  This could have been done in 2 months if the seller had a better team on it.  Good luck!  I'm sure you will get approval soon.

Donna, thank you for the encouragement.  I speak to the paralegal in my attorney's office often and emailed her Kathy Robinson's contact information. She forwarded it to the sellers paralegal. Whether they act on it I don't know. Fortunately my EMD is only $1000, so I can walk at any time. However the contract price is about 85% of what I believe to be the value of the house and comparable houses.  I am reluctant to get into another SS, as I had one previous failure where the seller didn't qualify for hardship, (not even close) and I wasted 5 months.

Minor update. The contract of sale between myself and the seller had a few items that were crossed off and changes written in by hand. The bank wants the pages where there are corrections printed showing the changes and sent to them. This mean anything? Again tomorrow marks 4 months since I signed the contract.

The fact that the bank is looking so closely at the document is a good thing.  That means your offer is seriously being considered for approval.  Send them the original printed copy so they can see what was crossed out.

Thanks, Donna. They already have the original but it is a good suggestion to include a copy of it with the new printed version. The seller's attorney is handling it as they generated the contract. Hopefully they are smart enough to include the hand written original to make sure it is changed correctly. 

Anyone want to take bets when we should receive an answer one way or the other?

Unfortunately didn't happen this week. Pretty gutsy prediction on your part. Hopefully next week. I come from the land of a 6 months short sale being quick.

The seller's attorney received the approval letter today.  So your prediction was spot on considering it probably took two business days for the mail.  Do you have some kind of crystal ball?

LOL!  No crystal ball, just a lot of experience and some good intuition!  Thanks for letting us know and good luck to you!  P.S.  Short sales should never take 6 months!
