I am not on my third auction.com go around with three different sellers. One didn't even go through after the winning bid was one on auction.com. The other 2 properties, went to auction.com and my buyers had the highest bids. How do we stop these people? I refuse to take another Nationstar deal. I have over 25 deals all with Nationstar. I rather not make the money, then help Nationstar get their money back.

I know what you are talking about. Here in NJ they have tried to make me place my listings on their Auction.com web, I have told them straight up that they are not my clients real estate broker and that if they are practicing RE in the State without a lic the AG would love to have a talk with them. All 4 of my SS have gone my way, but you need to find the legality of them forcing you to put the listing on a web site. I know that NY is tough as hell, but not sure on this case. Check it out and perhaps speak to your RE Commission.

I just got off the phone with CAR legal here in CA and they informed me that there is nothing we can do unless we all just stop taking NationStar SS. It was a very discouraging phone call.
There are 4 states exempted from using Auction.com: Missouri, Montana, South Dakota and Maryland.
Even with HAFA they are making my clients go through the auction.com process. I just had one case where I was already in contract and they saw the listing on auction.com so they place a LP against the property.
We have recently been successful by drafting a letter on behalf of our sellers citing a litany of legal issues outstanding and advising them that the listing agent is not allowed to relay information to their agency. Nationstar then goes silent and just proceeds with business as usual without utilizing Auction.com services. We have moved 5 ss forward using this process since my last post.

Good Luck! We all have to work together to keep these banks in check. Too many horror stories of banks controlling the agents just so the listing agent gets a pay check. I have heard too many times from negotiators "Other agents do it. Why don't you?" I am not other agents and I have a fiduciary duty to my sellers.
