Five Things To Avoid When Writing Your Short Sale Hardship Letter

When working with Massachusetts short sale candidates, the most daunting task always seems to be writing the hardship letter. All homeowners requesting a short sale are required to provide the lender with a hardship letter. The hardship letter is your best, and only, opportunity to explain to the lender why you are no longer able to afford your…

Buyers Lender Demanding Short Sale FULL approval letter now

So it seems to be a growing trend now that a buyers lender is demanding to see the lenders full blown short sale approval letter, not just the cover page with all the terms. In the past i have always taken the approval letter and removed the SS# and Loan# for obvious reasons. I got a call yesterday from a buyers lender demanding to see all the pages of the approval letter, that clearly have no information that they would need.…

Los Angeles CA – I recently received an e-mail from another real estate agent. They were asking for our advice on a short sale.

How can I land a property for my buyers if the property goes to Trustee Sale??

HELP!!!!

My clients have been waiting on a BofA short sale for 5 months.  This is the ONLY house they want to buy - it's perfect for their huge family and horses.  The sellers were cooperating for the first few months but then suffered a family tragedy and went MIA.

Now, BofA has no choice but to foreclose.

My clients are DEVASTATED at the thought of not closing on the property.  Has anyone had success in getting a bank to sell to the short…

Banks Quaking at U.S. Treasury Department Oversight

Finally, distressed homeowners and those looking to modify their loans are getting a chance to shake up the banks thanks to the US Treasury. Shock waves are rolling though the banking community as the Treasury Department causes fissures in the banks cavalier handling of underwater homeowners.

Complaining to the Treasury Department forces the bank to expedite your request for a loan mod because the Treasury Department can shut a bank down. Your bank can be fined and is quaking over the… Continue

BBB: American Homeowner Preservation Gets an 'A'

CINCINNATI, OH - April 12, 2011 –

The Better Business Bureau recently gave foreclosure prevention company American Homeowner Preservation (AHP) an "A" rating. AHP provides a short sale leaseback program to families who owe more than their homes are worth.  When existing lenders approve, families are able to short sell and stay in their homes… Continue

ING Direct Blacklists American Homeowner Preservation

ING Direct, the Dutch-bank and internet-based mortgage lender, has objected to American Homeowner Preservation’s program to keep families in their homes, and ING will no longer consider AHP short sales. “ING DIRECT will also be adding your company to our exclusionary list as your company strictly finds investors to keep sellers in their home, while the bank takes a significant loss.  This is against ING DIRECT’s short sale policies and guidelines, and as such you will no longer be able to work… Continue

As we approach the tax filing deadline, the Internal Revenue Service is reminding taxpayers that any canceled debt following a short sale, foreclosure or restructuring of a mortgage must be treated as taxable income unless you qualify for an exemption.  In general, when a creditor cancels debt, such as unpaid balances on student loans or credit cards, the…

3 borrowers, 2 defaulted loans and a prior short sale gone south due to agent's forgery

Any feedback? From what I understand and as of HAFA updates published by NAR on 03/16/2011, FHA loans are not eligible for HAFA because FHA has their own process for short sales? This is situation, homeowners are 3 on title and only 2 are ready, able, & willing to proceed but the 3rd is incognito. Plus they have FHA financing on first with BofA former CW loan and there is a 2nd that was also CW and now owned by BofNY Mellon, serviced by GreenTree and both loans recorded NTS. The first… Continue
