Cindy the homeowner has the right to make a direct appeal to the MI company. Have your seller write out what they can contribute and why. If all they can contribute is the 3000 received from HAFA, then that is all, but have them tell the MI company why. Ask the negotiator to send over this explaination to MI and ask for the name of the MI company so you can appeal to them yourself as well. If they refuse, let them know that legal counsel has advised that you submit at QWR to discover the name of the MI company. They will move on this. A Q WR is a Qualified Written Request for the lender to disclose information about this loan. They must comply. Talk to your favorite attorney about using this tool for your short sales. A QWR submitted with a short sale stops any credit reporting for a time on the homeowners credit report as well until the QWR is resolved. Many times a QWR will cause them to stop fooling around on the file.
