I'm helping a buyer purchase a Sun Trust short.  We submitted our offer on February 8.  I don't have authorization, but the seller's broker has been told, repeatedly, that the seller does not need to be approved to do an FHA short sale.  We have not had a BPO.  Where do I raise the alarm.  Sun Trust Corporate?  FHA Fraud?

Its a bit frustrating because I'm not authorized.  I don't usually deal with this side, but I need to give the seller's broker some ammunition.

SOunds like the listing agent is a rookie and TRYING to impress someone, most likely his Seller. Ask him to see a copy of HUD Form 90045, it shows eligibility, listing price recommendation, etc. ASSUMING the agent really did submit your offer on Feb. 8, this should be resolved sooner than later. Suntrust is currently running 60 to 90 days on decisions, depending of course on who the investor is on the loan.

Its killing me. They act like they know exactly what they are doing but they blame everything on the bank. But its killing my buyer because the marketing period has not begun yet. We could be 4% lower by now if somebody had done their job. Thanks for the encouragement. I'd like to alert the FHA to the situation. Do you have a contact there?
You could go to Google for FHA numbers or have your title company pull title and see who is on the title/deed to get the EXACT informaion you are seeking.
If you are that serious about pushing the issue (GREAT if you are), report the lender to the OCC, Office Of The Comptroller Of The Currency, I have numbers for them if you need.

The OCC is over the FCC and all others, tthe be all end all for complaints about lenders (you can also contact your state's attorney general for complaints).
You can also file a fomral complaint with the listing agent's broker.
