My seller filed bankruptcy after getting such a crappy workout from PNC 2nd. This line of credit was $24K and they demanded my seller bring $14K to table plus the first $3K=$17K was nuts and
The BK has gone thru and now the BK attorney says put the file back thru and try it again. I have have nothing to lose. Does any one have any experience with a seller filing BK and have it all done and then going back?

Thank you for your response. Do you have ANY suggestion on how I make this work? The second is a HELOC. The Sellers, Buyers, Agents all are very cooperative and wanting to make this work. I'm still going to see if I can find a number to somone that can do something at PNC. Let me know your thoughts if more. Thanks again.

I have completed several short sales with PNC as the second. How is the second structured? Is it a HELOC? If it is HELOC, then PNC told me on 2 others seconds as HELOCs that they do not release their deficiency rights because of how the loan is structured (and it is my understanding that a HELOC is a different type of debt that can be charged off - in other words, sold to a collections agency who will then try to collect on that debt - many times for more than the $6000 that HAFA would have provided). In those situations, PNC told me exactly the same that they have told you - we offered to do a promissory note, and were told no because of the structure of the loan.
Can anyone provide me with the most effective and direct method to escalate a PNC second? I had a HAFA short sale approval from BofA and PNC would not cooperate. We have converted the first to a regular short sale and agreed to PNC's request for 17k to release the lien however we will not agree to the 155K as a deficiency. We offered to carry a note for 30K as full settlement in addition to the 17K and they denied. Any suggestions?
