My agent and I have been working diligently to get into HAFA through BofA.  My experience of calling BofA is like you are a dog chasing your tail. Hours on the phone with idiots who don't know what they are doing, being transferred to other idiots who are clueless...I can tell everyone on this forum has experienced this. My agent has been following the Equator directions and following up. We sent in all info to AMS (outsourced servicer) on Sept 10. IWe found out we were put in foreclosure on Sept. 14. Our home is scheduled for sale Nov. 2.  My agent and I both spent hours on the phone with BofA trying to get this changed to no avail. So to cover ourselves, we decided to place my home on the market with a guess at the BPO and not submit offers until we had the HAFA approval. According to Freddie Mac, you get kicked out of HAFA if you submit an offer prior to approval. On Oct.6, a negotiator from BofA asked for updated info which we got in immediately.  We got house on market and got an offer within a week, Oct 8.  News that BofA had stopped foreclosure sale was  great so we relaxed a little. Then, yesterday, Oct 15, I found a post on the internet saying that a homeowner in NC found out her home was still being sold. Apparently, despite headlines ALL BofA foreclosure sales have NOT STOPPED. So I followed up with my agent who called the foreclosure attorney who confirmed we are still scheduled for sale Nov.2.  My agent called AMS who assured her we could submit our offer since we were at a certain place in the process. I asked to contact Freddie mac to verify this...She ended up reading the entire Freddie HAFA directive which said Homes can not be put into foreclosure while in the HAFA application process. She contacted the Negotiator through equator asking for action and quoting Freddie. I called BofA...again another hour like a dog chasing its tail....They were surprised the foreclosure sale was still scheduled..of course, because no one there knows anything about anything. I escalated to supervisor who said all he could do was send a message to the negotiator..which of course was what my agent had already done.
HELP!  Should we submit our offer to stop the foreclosure?  we are now at 2 weeks until the sale. We have in good faith followed every direction that BofA has asked. Apparently, HAFA has been approved for the first loan and now waiting for the second.......
