I have been working with BofA for the past month on a cash transaction and a trustee sale date of this Friday. I am being told that they won't postpone the Trustee Sale unless the file is in closing.

Anyone have suggestions for getting a 30 day extension?

Escalate it to Brian T. Moynihan ([email protected]).  Send an email and briefly state the facts and what you need to have happen. Send back-up info. You will receive a response right away. Good luck! Let me know what happens! :>)  Do it right now!
Celeste is absolutely correct.  Brian should be able to help. You should also have your Seller call and demand to know why they are not working with you on a short sale. Tell your Seller to indicate that he has not received the proper notifications of alternatives to foreclosure.

Hi Randy,

I had this exact same issue a few weeks ago. I  contacted Allan at [email protected], he is the west coast loss mit vp, I sent him a very detailed email with the chain of events and told him I was going to go to all my local media venues and let them know BOFA is not helping their customers avoid foreclosure like they claim, low and behold I got an approval letter with in 24 hours ( I had been trying to get an approval for 8 months and then got a denial a week before it went to sale), funded and recorded the day before the sale date since it was an all cash deal......if you are the east coast try emailing John at [email protected] he has the same title for east coast BOFA props....Good luck, I hope this help you!!

Ahh... start at the top and let the Executive Office assign an escalator.  It's more effective.  They call me and send me emails all the time now to see if I got my questions resolved, and ask how my short sale transactions are going.  I was persistent, but never used the local media as a venue.  They do have an escalation Dept, but you want it to come from the Executive Office.   I know I'm posted on their bulletin board!!

Thanks everyone - I have sent an email to Mr. Moynihan requesting his assistance in getting the trustee sale postponed by 30 days. Now we wait.... Hopefully we will have news tomorrow.

Thanks again for your help!

We lost this property to the Trustee Sale. I was on the phone with BofA trying to get the sale delayed as the Trustee was reading the property description and holding the sale. There were no bidders, so it reverted to BofA. Now I need to find out who will be in charge of it as a REO so the buyer can still buy it. Any ideas on tracking down the asset manager for the BofA REO?
