I have a seller that we had a offer in and we got a verbal approval from the Suntrust negotiator with a 10k promissory note and my seller agreed.  We never get an approval letter.  We get the closing specialist emailing me asking for a closing date.  I tell her that our negotiator never gave us promissory note or approval letter.  She then emails negotiator and ccs me asking for him to take care of this.  Almost two months go by and not a word from him.  This is with the seller and myself calling in to check in and leaving messages.  He finally responds two weeks before sale date asking for updted purchase agreement and HUD.

 

Two days before sale date he tell us that the investor will not postpone and we went to foreclosure.  I have emails from him and closing specialist to prove that we had an agreement.  Does anyone know of a way that I can rectify the situation?

You can ask Suntrust to rescind the foreclosure, but it will be tough!
