Short sale and Bankruptcies

I just got off the phone with a client who is wanting to complete a short sale on her property. The home was part of the bankruptcy, however the attorney noted it as their homestead. Can I legally do a short sale on this property?? I have always heard to be cautious when dealing with a bankruptcy. Please help!!

If it's chapter 13 you need permission from the court, if it's chapter 7 they will wait until discharge.

You might have to put a 'freeze' on the listing for a short while. Get in touch with the bankruptcy attorney, he should know when you can move forward. In the mean time I would get all the paperwork together with the seller.
