HOA outstanding balance NOT being paid bc TX is NOT a "super lien state"

Good afternoon yall,

Ok, so this is the first we've had a catch on this.  We've got a BofA serviced file that requested the worksheet to be countered on Equator as they will not pay the $500 past HOA dues from the last year.  They are telling us that because TX is not a super lien state; they will not nor do they ever agree to pay any junior liens behind the first. 

Has anyone else ever heard of this before?  We'd love to hear if anyone else has seen this before.

What's really crazy is we had this investor agreeing to pay the past due HOA dues on two OTHER approvals we had from buyers that ended up backing out later on.  We are pulling money from somewhere, but just really frustrating.  Thanks Brian

You can try negotiating with the HOA if no one will/can pay the $500. They might be happy to just have a new paying owner when the property closes, so may settle for less.

Great idea.  This HOA has denied our request 3 times which baffles me.  We thought the same logic when approaching them, but they were no go.
