Hi all, I'm looking for some help in getting an FHA short sale out of the starting gate. Property is owned by 2 people as joint tenants with right of survivorship. There is a Judgment entered against one of the 2 owners. In Maryland, a Judgment against one joint tenant is NOT a lien on the property. I have written Wells Fargo an Opinion of Title on my law firm letterhead specifying the situation in great detail and even provided copies of the vesting Deed and the Maryland court case that established the legal principle.

I've sent the Opinion of Title a half-dozen times and called dozens of times over the last 6 months. Despite speaking to supervisors several times who supposedly understand the issue and have escalated to a supervisor in the FHA set-up team, Wells refuses to initiate the short sale until the "lien" is cleared despite my repeatedly demonstrating that the Judgment is not a lien on the property.

Despite numerour requests, Wells will not allow me to talk with anyone in the FHA set-up area who keeps declining to initiate. Any ideas on how to get this one moving? Anyone know a contact for a supervisor in the Wells FHA setup area? Anyone know someone at FHA who can intervene with Wells? Thanks.

Sounds like you have been plugging away at this for a while .Did you try the FHA National Servicing Center 877-622-8525? You will need a LOA and would be helpful if you have FHA case number.  Good luck!
