Hi all.
We are getting close to purchasing a short sale, and they have a nice built-in BBQ that is NOT included in the purchase. Are we allowed to purchase the BBQ from them?

That is personal property if not included as part of the purchase.
Thanks. My agent is saying it's illegal or against bank rules to have dealings like that with Short Sellers. We may have to sign an affidavit saying this is an arms length transaction. But I never met the person before we offered.
Then sign it if you are not related you are not related. Is your agent telling you if that seller has a garage sale the day of the close that you cannot buy anything from the garage sale. If so why not? Of course you can as well it is of no concern to the agent.
There are no restrictions against you purchasing personal property from the seller. It really has nothing to do with the purchase of the real estate and has nothing to do with your agent.
This assumes that this is a legit purchase and is not just away to funnel cash to a seller outside of closing.
Here's an article I wrote about this exact scenario http://centralfloridashortsales.com/post/3500729/can-i-sell-my-appl...
Thanks. That is what I figured, but I didn't know if there was some law I didn't know about as that is not my area of expertise.
