I submitted a short sale packet last week.  A negotiator was assigned yesterday.  The negotiator is saying he will not approve the short sale because the home is empty.  Scheduled foreclosure date is February 21, 2011. Does anyone have any experience/advice on what my next step should be? Can I fight this?

I just closed a short sale with AHMSI - they were very cooperative. Were you able to get them to forestall the sale?

Hi Rick,

Unfortunately, I was unable to delay the foreclosure.  All, in all it wasnt a bad experience.  The negotiator reviewed the packet within one week of submission.  I am trying to remain the listing agent once the property comes back on the market.  However, the next time I hope for a successful transaction.

Sharon, I  know this is a little late ,However I always check the investor if I can. That sounds like FHA. Home cannot be empty unless there is a good reason. They want to know why occupant left home. Hope this helps. /
I have done 2 AHMSI short sales and both were vacant.  Keep pushing and escalate your file beyond the negotiator, they will postpone.  DON'T hold your breath about getting the listing after it forecloses, AHMSI will hire an asset manager to dispose of the property.  If you have the buyer too, find the agent in your area that sells AHMSI REO and tell them to call you as soon as they get the assignment
