I have an approval letter stating that the buyer must close by 5/1/2011. The buyer is actually cloing by 4/21/11. Today I received an e-mail from the negotiator telling me that the foreclosure date (4/12/11) cannot be extended and that the "portfolio manager" has instructed the foreclosure to proceed. Has anyone had this happen and if so how did it get resolved?

Yes...I was in the same situation - insist on going forward with your short sale and that your buyer is anxious to close...don't give up! we did CLOSE!

Thanks Rick,

The negotiator was a complete ASS......so I called the trustee listed on the NOD and gave her the information. She called me back in an hour to let me know that the date was extended to 5/22!! My client is closing next week :) The funny thing was on monday morning i got this e-mail from the negotiator:

"I don’t know if you are aware or not but for whatever reason the sale date was postponed until 5/12/11. The approval is still valid if the buyer is still on board."

I didn't respond.....no need!
