Need help - I can sell the home for more than 1st mortgage, but 2nd mortgage is not going to get paid off completely. How to proceed?

They do NOT have to participate in the short sale at all. although if the seller is delinquent and facing foreclosure be sure to let them know you are selling the property. The short sale submission is to the 2nd only.
