I have an upcoming short sale with Ocwen on the 1st and BofA on the 2nd.  The couple has been divorced for at least 4 years. He is living in another state, she is in charge of the residence.  He has really washed his hands of the house.  I am suspecting it will be like pulling teeth to get his paperwork for submitting the short sale. Can he be quit claimed off title hoping that I only need to get her paperwork?  Your experience will be greatly appreciated. Thanks

Thanks everyone.  I spoke to the 'former' and he is willing to cooperate.  I understand I should be posting my questions in the forum.  I will find my way through this site. It is a wealth of information.

Hi Christine. You will always get a better response to questions by posting in the forums. Blogs are for sharing information. Forums are for asking questions.

Doing a quit claim would get him off of title but if he is on the loan then he must participate in the short sale. I've done many divorce related short sales. The advantage to the ex spouse is to avoid the foreclosure and any future liability for the loan.
