We have a short sale with Capital One right now...they are the only mortgage on the property. We submitted a full short sale packet to them on April 6, 2011 with a good offer. On April 8, 2011 the sheriff/foreclosure sale was held. In Minnesota, the redemption period is six months from that date, so the foreclosure will be final on October 8, 2011 (still another 4-1/2+ months).
We keep calling and getting the "run around" from Capital One...telling us they can't do the short sale, it's already been foreclosed on and we have to contact Fannie Mae. We try to explain the redemption time period and that a short sale can be done in this time, but they insist we have to go through Fannie Mae.
So, we contact Fannie Mae who of course tells us they can't do anything until after the redemption period when the loan is back to them and the foreclosure is complete.
We cannot get anyone at Capital one that cares or wants to help or will listen. Does anyone know someone we can contact or have a number or email we can try? We do many short sales with many different lenders without this issue, but this is our first with Capital One and it is extremely frustrating...any help or information is very much appreciated!
