Does anyone know if BofA requires a buyer's disclosure affadavit or letter prior to sale ? I understand that almost all other banks require one, but as of the moment BofA does not.

Not sure but you can call customer service and they might know. Even if you are not the listing agent customer service will answer your questions but will not tell you anything about the file. I know because I just called the other day.

If you mean a hardship letter and a financial statement, the answer is yes!

No. I have those in place. The affadavit I speak of requires the buyer to disclose any family relationship; any business relationshhip; and the fact that you will not resell or lease to the current seller in the future.

Attempting to short sale through Equator. BofA "snafu" (as usual) saying that the seller doesn't qualify for HAFA because he didn't make the 1st payment of a new mortgage contract from them which was turned down and not signed because they applied the wrong financials to the modification offer, which came in higher then the one we wished to modify. Upon explaination of this screw-up they agreed but refused to accept the seller into the HAFA program. How can one deal with these idiots ??
