Does anyone successfully obtain approval of a HELOC loan without deficiency clause ?  The seller offered some cash contribution in exchange for deficiency clause removal but BOA refused. The supervisor said no exception for HELOC loan.

Do you think that's because CA is a non-judicial foreclosure state? OR is as well but I have yet to talk to anyone that has had success getting BOA to remove the deficiency language. How did you do it? Feel free to call me or email me directly [email protected] 541-330-0588. Thanks!

Cheri, CA is anti-deficiency state. If you have original purchase loan and owner occupied, you have a case. Go up to the top, they will remove deficiency clause for you. If it is refinance loan, you can negotiate with BOA to bring in some cash or promissory note in exchange for deficiency removal. HELOC is different. BOA will NOT remove deficiency no matter how much noise you make. I tried but I was unsuccessful on the HELOC. I even filed a complaint with OCC, it did not work either. I would like to hear from anyone who is successful on the HELOC.
