Per the FHA Guidelines, the borrower must first apply for a modification and get denied. If the borrower previously applied for a modification was approved or denied then submit the proof of the denial or approval of the modification. The only way FHA will waive the modification is if there is a job transfer to another state, death of the primary borrower and that is on a case by case basis. I am a DE Underwriter and Realtor and have closed quite a few FHA short sales with various lenders.
