@allan, thanks. Well I found out this afternoon that the short sale was declined due to the property being vacant. I haven't been able to get in touch with the rep at Ditech about requesting a variance but have left a couple messages. I assume the rep doesn't know about variances.

Hi Luther. You're doing too much thinking here. There used to be an occupancy requirement for the PFS Program. But since the ML 00-05, the lender has been allowed to make reasonable exceptions for vacant properties especially if the homeowner is forced to more to find employment. Below is the link to the PFS mortgagee letters. Pull the ML 14-15. They have eligibility requirements for non-owner occupants. You can do a streamlined PFS sale however the homeowner is not eligible for the $3000 relo incentive since he has already moved out of the property.
It's the job of the negotiator, not the agent, to determine when to use the variance. The only time i get involved in a variance is if it has been denied.
Kudos on being a very enthusiastic short sale superstar. Your clients are lucky to have you.

@brett...the house is vacant so i'm certain a variance would need to be requested. I will do something in writing and see.
@luther what is the variance for? Generally the negotiator submits for a variance to HUD. Asking for something in writing never hurts. I haven't seen Ditech service FHA loans, they appear to primarily service notes for Fannie Mae.

I have a short sale with one mortgage serviced by Ditech. It is FHA backed so I know we will need a variance exception. I have been trying to contact the rep at Ditech for several days now and they are not returning calls. My question is do we make a written request for a variance when we submit the short sale package?
