Like so many, I cannot get to a resolution with Ocwen.  IndyMac approved our short sale in Nov 2013 pending a BK Court approval.  The court took the full 30 days to sign off and the servicing was sold off to Ocwen.  After a year of fighting with Ocwen we're back to the original decision with IndyMac but I cannot get in touch with any one in the legal dept at Ocwen?  I would be forever in your debt if you can help me with any information or contacts with Ocwen legal?

CA is working to get Ocwen banned from loan servicing here, although they currently service 26% of all mortgages in the state.  Banning them would be at least a start to recovery.

Dear Michael,

Thank you for your post.  I have now contacted you 3 times, as well as the escalation dept and the Ombudsman, but the "team" at Ocwen never responds.

There is a very important legal question regarding this transaction, and thankfully the CDBO is concerned as this sale was approved by Indymac pending a BK court approval letter.  Ocwen took over servicing within the 30 day window according to BK law.  Is that legal according the PSA?  IndyMac still owns the note.

I've already sent you all the pertinent documentation without a response from your team of course.

Let it be known that Ocwen does not assist in transactions, they are a paid servicer.  This file has been "serviced" bi-weekly for over a year. 

Out of courtesy, and according to your post to me, please respond.

My apologies.  Ocwen, the servicer, has denied the short sale 4 times in the last year.  Does Ocwen have the right when they do not own the note?  Not according to the PSA.

Many times servicers do not own the note, but they "service" the loans under certain guidelines on behalf of the investor. From my understanding they are denying it on behalf of the investor for one reason or another. Why is the short sale being denied at this point in time?
