Has anyone done a FHA short sale with BOA and had the representative say the client can not do a short sale....... I have never had someone flat out say they can not do a short sale without reviewing the file.

I would ask to speak with their supervisor if they were unwilling to tell you why. If they had a qualified hardship it doesn't make sense.

My client has a valid hardship and all the documents we submitted proves it... I have a appointment to speak with the person who is assigned to the file tomorrow morning. I just wanted to see if anyone has experienced this before and what I can do about it.

Have they been denied a modification. ie BofA requires the homeowner go thru the "waterfall".

My client has not been denied from a loan mod. I will go over that with BOA. THANK YOU

You either misspoke or don't understand. HUD requires that the seller submit financials (periodically) to be sent to underwriting to be considered for a loan mod. If the numbers show that a loan mod is reasonable, no SS will be allowed. So, saying she wasn't turned down for a loan mod would be a bad answer, but I don't think you meant it in that context.

The "attempt" is a required step for FHA. (If the property is not owner occupied, a loan mod is not possible, btw.)

As mentioned, you need to find out why. HUD has strict rules like the property MUST be maintained (or no SS). BofA "specialists" seem to be on a tight leash to just state the facts. I spent weeks on an issue (one word missing in the BofA required statement) trying to get the specialist to explain the problem and got just the original statement over and over. They can get into trouble for giving you too much info (although, they don't have to be ignorant robots).

If you get nonsense from them, contact HUD. The first contact may be useless. If so, call back and explain that it resolved nothing, or whatever. That will get you escalated (also, the 1st call will be routed directly to BofA, believe it or not).
