A BK will stop the bank from collecting the debt, but does not lift the lien.  Most homeowners are not aware of this and they think the BK allows them to keep the home without paying for it.  Something to keep in mind when talking with sellers about a Short Sale and BK.

I was hoping we could send some comments during the webinar, because I have one where I'm the buyer's agent and it took them 9 months to approve! We kept hearing they were swamped over and over.

@Celeste - Apparently, they are supposed to know about these files before asking for financials. My negotiator did not. I alerted her, and she apologized for "overlooking" the BK.  So, I guess the lesson here is - the negotiators are not always  checking for BK status (whether the note was included and discharged) when you initiate files. She did not ask for proof - she did have it in her system but had not checked it. Good luck with your short sales!

Wendy, I didn't have to say anything to the bank.  They already know when the borrower has filed a BK - public records.  The ones I am doing have been discharged already and it included the two liens. Not finished with them yet, but will let you know how it goes.

@Wendy - we do short sales on BK properties regularly.  In fact, we do joint marketing with a BK attorney to properties on the foreclosure list.  You will need to get an authorization letter from the BK attorney representing the seller that states it is permissable for the bank to communicate with the borrower or their representative (you) while in bankruptcy.  The rest of the short sale process is basically the same.  It takes somewhat longer because the bank will need to research and verify the BK.  The seller's BK attorney must make a motion to the judge to release the property from the bankruptcy prior to closing.  This can cost additional $$, beware.  Someone has to pay the attorney and fees.
