Negotiating with the IRS over tax lien

I have a situation where I am short-selling a home for a divorcing couple. Divorce decree is final. Husband is living elsewhere and divorce decree makes him solely responsible for a $148,000 IRS tax bill. Unfortunately, the IRS has already put a tax lien in place on the property. Husband signed a Quit Claim deed to property and no longer lives there. Attorney advises the tax lien will remain - it attaches to property, not to the person who owes the bill.  Sellers owe $258,000 to lender.…See More

Divorcing Sellers, Financial Worksheet Question

I have sellers who are separated and living separately. Not divorced yet. Home is owned by both, on deed and mortgage. Will need to be a short sale. Ocwen is their lender. Wife is still living in home, husband has moved out. Should wife fill out Ocwen's financial worksheet with just her info?  Or include husband? Husband makes enough money to pay the mortgage, but not when his separate household expense is added in. Will husband need to sign a quit claim deed to complete the short sale?  Ocwen…See More

"You don't need an offer to be approved for the PFS program, and HUD can postpone the auction if it wants to. This is one instance in which you're lucky this is an FHA short sale. Most other short sales would require an offer."
