Is the buyer obtaining financing on this transaction? The reason I ask is... I have actually closed deals for agents that could NOT get their title agents to put items on the HUD where the bank says they want them. FHA is very strict where they want water bills/Hoa fees/liens in the 400 line series and then paid out on another line of the HUD so that it is a wash. It is unfortunate that some of the new programs that came out with the new 3 page HUD does not allow closing agents to over ride the program, together with lack of understanding the program and trying to be compliant with RESPA changes to the HUD. If this is a cash deal it does not fall under RESPA guidelines and they can use the OLD version of the HUD. I agree with the comment to find another closing agent. If you need a HUD done for an approval until you find a new closing agent I will help you out.
